Terms of Service

By downloading, installing, or using MORFYN ("the App"), you agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and any additional guidelines or policies referenced herein. If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and MORFYN (operated by Diyorbek Ermamatov, dba DiorDev).

You may use MORFYN only if:

• •You are at least 17 years of age (as required by the App Store age rating)
• •You have the legal capacity to enter into a binding agreement
• •You are not prohibited from using the App under applicable laws in your jurisdiction

By using MORFYN, you represent and warrant that you meet all eligibility requirements stated above.

3.1 Registration: To use MORFYN, you must create an account using a valid email address or through Google/Apple Sign-In. You agree to provide accurate, current, and complete information.

3.2 Account security: You are responsible for maintaining the confidentiality of your login credentials. You agree to notify us immediately at [email protected] if you suspect unauthorized use of your account.

3.3 One account per person: You may not create multiple accounts or share your account with others.

3.4 Account termination: We reserve the right to suspend or terminate your account at any time for violation of these Terms, at our sole discretion, with or without notice.

4.1 Free tier: MORFYN offers a free plan with limited features. No payment information is required to use the free tier.

4.2 Pro subscription: MORFYN Pro is available as a monthly ($9.99/month) or annual ($59.99/year) subscription, processed through the Apple App Store.

4.3 Free trial: New users may be eligible for a 7-day free trial of MORFYN Pro. The trial automatically converts to a paid subscription at the end of the trial period unless cancelled at least 24 hours before the trial ends.

4.4 Billing: Subscriptions are billed through your Apple ID account. Payment will be charged to your iTunes Account at confirmation of purchase. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.

4.5 Cancellation: You may cancel your subscription at any time through your iPhone's Settings → [your name] → Subscriptions. Cancellation takes effect at the end of the current billing period — you retain Pro access until then.

4.6 Refunds: All purchases are processed by Apple and subject to Apple's refund policy. MORFYN does not directly process refunds. To request a refund, visit reportaproblem.apple.com.

4.7 Price changes: We reserve the right to change subscription prices. We will give you reasonable notice of any price change. Continued use of your subscription after the price change constitutes acceptance of the new price.

• •Always consult a qualified healthcare professional before starting any new diet, exercise program, or making changes to your existing regimen
• •Do not use MORFYN to diagnose, treat, cure, or prevent any disease or medical condition
• •If you experience pain, discomfort, or any unusual symptoms during exercise, stop immediately and seek medical attention
• •The calorie and nutritional information provided may not be 100% accurate. Consult a registered dietitian for precise nutritional guidance
• •MORFYN's AI-generated advice is not a substitute for professional medical, nutritional, or fitness coaching

By using MORFYN, you acknowledge and accept that fitness and health activities carry inherent risks, and you assume full responsibility for your participation in any exercise or nutrition program suggested by the App.

You agree to use MORFYN only for lawful purposes and in accordance with these Terms. You agree NOT to:

• •Use the App in any way that violates applicable local, national, or international laws or regulations
• •Attempt to gain unauthorized access to any part of the App, its servers, or any connected systems
• •Reverse engineer, decompile, disassemble, or attempt to extract the source code of the App
• •Use automated bots, scrapers, or other automated means to access the App
• •Transmit any unsolicited or unauthorized advertising or promotional material (spam)
• •Impersonate any person or entity, or falsely claim an affiliation with any person or entity
• •Upload or transmit any content that is illegal, harmful, threatening, abusive, or otherwise objectionable
• •Attempt to interfere with the proper functioning of the App or its servers
• •Share your account credentials with others or allow unauthorized use of your account
• •Use the AI coach feature to generate harmful, illegal, or medically irresponsible content

MORFYN and all content within it, including but not limited to text, graphics, logos, icons, images, audio clips, and software, are the exclusive property of DiorDev and are protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use MORFYN for your personal, non-commercial purposes. This license does not include the right to:

• •Reproduce, distribute, or publicly display any content from the App
• •Modify, adapt, translate, or create derivative works from the App
• •Use any content from the App for commercial purposes without express written permission

Any feedback, suggestions, or ideas you provide about MORFYN may be used by us without any obligation to compensate you.

MORFYN may allow you to input data including meal logs, workout records, journal entries, and messages to the AI coach. By submitting content, you grant MORFYN a non-exclusive, worldwide, royalty-free license to use, store, and process this content solely for the purpose of providing the App's services to you.

You represent and warrant that you own or have the right to submit any content you provide, and that your content does not violate any third-party rights or applicable laws.

MORFYN integrates with third-party services including OpenAI, RevenueCat, Google, Apple, and others. Your use of these integrations is subject to the respective third-party terms and privacy policies. MORFYN is not responsible for the practices, content, or availability of third-party services.

In particular, Apple's Terms of Service apply to all purchases made through the App Store. MORFYN's AI coach responses are generated by OpenAI's models and may occasionally contain inaccurate or incomplete information — always verify important health information with a qualified professional.

MORFYN is provided on an "AS IS" and "AS AVAILABLE" basis without any warranties of any kind, either express or implied, including but not limited to:

• •Warranties of merchantability, fitness for a particular purpose, or non-infringement
• •That the App will be uninterrupted, error-free, or free of viruses or other harmful components
• •That the results obtained from using the App will be accurate, reliable, or meet your requirements
• •That any errors in the App will be corrected

Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you.

To the fullest extent permitted by applicable law, DiorDev shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• •Loss of data, profits, or revenue
• •Physical injury or health complications resulting from following advice provided by the App
• •Unauthorized access to or alteration of your data
• •Any other damages arising from your use or inability to use the App

In no event shall our total liability to you exceed the amount you paid for MORFYN Pro in the 12 months preceding the claim, or $50 USD, whichever is greater.

You agree to defend, indemnify, and hold harmless DiorDev and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from:

• •Your use of MORFYN in violation of these Terms
• •Your violation of any third-party rights
• •Your violation of any applicable laws or regulations

We reserve the right to modify, suspend, or discontinue MORFYN (or any part thereof) at any time with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the App.

We may revise these Terms at any time. When we make material changes, we will notify you through the App or by email at least 14 days before the changes take effect. Your continued use of MORFYN after the effective date of revised Terms constitutes your acceptance.

These Terms shall be governed by and construed in accordance with the laws applicable in the jurisdiction of the developer's business registration, without regard to its conflict of law provisions.

Any dispute arising from these Terms or your use of MORFYN shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration or the competent courts in the applicable jurisdiction.

These Terms remain in effect until terminated by either party. You may terminate by deleting your account and uninstalling the App. We may terminate or suspend your access immediately, without prior notice or liability, for any reason whatsoever, including if you breach these Terms.

Upon termination, your right to use the App ceases immediately. Provisions that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) will survive.
